Granite Source Power LLC and its affiliates (collectively, our “Company” or “we”) are committed to maintaining the confidentiality and security of social security numbers that we collect in the ordinary course of our business.  In accordance with applicable laws including Section 501.052 of the Texas Business & Commerce Code, our Company has established this policy applicable to Texas residents, which describes how our Company collects and maintains the confidentiality and security of social security numbers collected from Texas residents (“you”).

1.   How your social security number is collected

Our Company collects your social security number directly from you.  For example, we collect your social security number when you provide us with a completed IRS tax form W-9 containing your social security number in connection with your business transaction with our Company.

Additional means by which our Company may collect your social security number are as follows.  Our Company may collect your social security number through our authorized service provider who collects it directly from you.  We may also collect your social security number from a third party to whom you provided your social security number, when the records containing your social security number are transferred to us as a business asset that is part of a merger or acquisition transaction that our Company enters into with that third party.

2.   How and when your social security number is used

Our Company will only collect and use your social security number if we have a proper business or compliance reason for doing so. Your social security number may be used by our Company for one or more of the following reasons:

• For processing and making payments to you when due;
• As part of receiving services from our authorized service provider if they handle your social security number in providing such services;
• For complying with our legal and regulatory obligations such as reporting payments made to you to the Internal Revenue Service and sending you IRS Form 1099s;
• For internal administrative, verification or other operational purposes and as applicable, detecting and protecting against any security incidents;
• As part of a merger or acquisition transaction that our Company enters into with a third party when records containing your social security number are transferred to the third party as a business asset in connection with such transaction; and
• With your consent, for any other lawful purpose.

3.     Protection of your social security number

Our Company will take reasonable steps to maintain the confidentiality and security of your social security number when obtained by us and in accordance with applicable law.  We have implemented and maintain reasonable security measures to prevent your social security number from being unlawfully disclosed, accidentally lost or used or accessed in any unauthorized way.

4.   Who has access to your social security number

Our Company restricts and limits access to your social security number to our personnel and authorized third parties who are subject to a duty of confidentiality and have a legitimate business or compliance reason to access it, except when fulfilling our reporting obligations to the Internal Revenue Service and as otherwise required by applicable law or court order or rule.  Our Company prohibits the unlawful disclosure of social security numbers.

5.   Disposal of your social security number

At the time of disposal, we will destroy records containing your social security number that are within our custody or control by shredding any paper records and deleting electronic records through the data deletion process available from and applied by our cloud service providers such as Microsoft.  Our Company does not store your social security number on any hardware of any computer, laptop or other device.
